1. Agreement to Terms
By accessing or using The Draw DIY website and services, operated by Draw Float DIY, DBA TheDraw DIY ("we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.
2. Description of Services
The Draw DIY provides a service that submits hunting license and tag applications on your behalf through the New Mexico Department of Game and Fish (NMDGF) website. We pay the upfront application and tag costs ("float") so you don't have to, in exchange for a service fee.
3. Limited Power of Attorney
To use our services, you must sign a Limited Power of Attorney (POA) authorizing us to:
- Access your NMDGF account using the credentials you provide.
- Submit hunting applications and make payments on your behalf.
- Manage your application cart as necessary to complete the checkout process.
This authorization is limited strictly to the application process and does not extend beyond the scope described above.
4. Service Fees
- New Mexico Residents: A flat fee as listed on our website (currently $99) to apply for all species.
- Non-Residents: Per-species fees as listed on our website, capped at the maximum listed (currently $599).
Service fees are in addition to any licenses, stamps, and application fees required by NMDGF. We reserve the right to update pricing at any time; any changes will be reflected on our website prior to your purchase.
5. Unsuccessful Applications
If you do not draw a tag, NMDGF will refund the application fees directly to us. No additional action is required on your part. Service fees are non-refundable regardless of draw outcome.
6. Account Credentials
You are responsible for providing accurate and current NMDGF login credentials. We are not liable for application failures caused by incorrect credentials, account lockouts, or changes to your NMDGF account that you do not communicate to us in a timely manner.
7. Application Deadlines
The Draw DIY sets its own internal deadlines to ensure we have time to process all applications before the NMDGF deadline. These deadlines are posted on our website. We are not responsible for applications that are not submitted due to late sign-ups or payments received after our posted deadline.
8. Group Applications & Outfitters
Group applications are supported and work the same way as applying directly through NMDGF. Each member of the group must have their own Draw DIY account and pay their individual service fees. We are not responsible for group application failures caused by incomplete participation from group members.
9. No Consulting Services
The Draw DIY is a self-service application platform. We do not provide hunt consulting, unit recommendations, or application strategy advice. For consulting services, please contact our parent company, The Draw, at 575-222-1234.
10. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any issues arising from NMDGF website outages, system errors, or changes to their application process.
- We are not responsible for draw outcomes, tag allocations, or any decisions made by NMDGF.
- Our total liability to you shall not exceed the amount of service fees you paid to us for the applicable application year.
- We are not liable for any indirect, incidental, consequential, or punitive damages.
11. Refund Policy
Service fees are non-refundable once your application has been submitted to NMDGF. If we have not yet submitted your application, you may request a refund by contacting us. Refunds are processed at our discretion and may take up to 14 business days.
12. User Conduct
You agree not to:
- Provide false or misleading information.
- Use the service for any unlawful purpose.
- Attempt to interfere with or disrupt the service.
- Share your account credentials with unauthorized third parties.
13. Privacy
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
14. Changes to Terms
We may update these Terms & Conditions from time to time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
15. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles. Any disputes arising under these terms shall be resolved in the courts of Clark County, Nevada.
